The issue of bail arises in every case, and in sex cases the police often detain people in custody before the first court appearance.
It is vitally important for a Defendant to put together a strong application with a package of conditions that will persuade the court that (s)he is not a bail risk. There is often a tension between a client desire to secure bail as soon possible and a lawyer’s wish to prepare an application which has the greatest prospect of success.
Weak lawyers often make bad applications and once turned down on the first occasion it is much more difficult to secure release the second time around.
